Your gas safety responsibilities as a landlord

You might think that you have enough to concern yourself with as a landlord in London or the Home Counties, even before you come to the subject of gas safety... but the truth is that this is an extremely important subject, for more reasons than one.

You certainly won't want to cut corners when it comes to your responsibility for the safety of your tenants – so here are some of the key things you need to bear in mind.

It's up to you to take every step to protect your tenants

For the purposes of the Gas Safety (Installation and Use) Regulations 1998, you are considered to be a landlord if you rent out a property that you own under a lease shorter than seven years or under a licence. Other related legislation exists that may, again, consider you a landlord, regardless of whether you are one according to the Gas Safety (Installation and Use) Regulations 1998.

Presuming, then, that you are subject to these regulations, you are legally responsible for the safety of your tenants, and therefore have certain duties to make sure gas appliances, fittings and flues that you provide for your tenants are safe.

Broadly, your gas safety responsibilities as a landlord can be divided into three main categories: gas safety checks, the Gas Safety Record, and maintenance.

With regard to the first of those categories, all of the gas appliances and flues in the property occupied by your tenants must undergo an annual gas safety check, carried out by a Gas Safe registered engineer.

On completion of this task, you will be given a Landlord Gas Safety Record or Gas Safety certificate that details all of the checks undertaken. It is this certificate that is also sometimes referred to as a CP12 certificate. A record of the check will then need to be provided to your current tenants within 28 days of the check – and at the start of a tenancy, in the case of new tenants.

As for maintenance, you'll need to ensure all of the rental property's gas pipework, appliances, chimneys and flues are kept in safe condition. The gas appliances' manufacturer guidelines will indicate how often a service is recommended.
